Glenora Receives Setback
In Battle for Glen Breton Trademark
 

Glenora Distillers (International) Limited regrets to announce that by a decision of the Federal Court, the ruling of the Trade-Marks Opposition Board allowing the registration of Glen Breton as the trade-mark of its single malt whisky has been overturned. The order, which has been issued by the Court, refuses the application of Glenora to register Glen Breton under the Trade-Marks Act.

“Having just received this very disappointing news, we are still reviewing the text of the decision with legal counsel. However, it appears that the decision is based on a conclusion that the word “glen” can no longer be used in Canada as a registered trademark for whisky, unless it is a scotch whisky. This decision could have serious economic ramifications for Glenora Distillers,” says President Lauchie MacLean.

Glenora has always proudly marketed Glen Breton as the only single malt whisky made in Canada. Glen Breton was adopted as its flagship mark to evoke the beauty of the Highlands in Cape Breton where its single malt is distilled and matured. It is also a reference to Glenville, home to Glenora Distillery and the many “glen” place names of regional culture, and to the pure waters of the glen stream used to produce our award-winning whisky. Glenora Distillery has tried to build the reputation of its distillery on the quality of our products, the integrity of our people, and the success of honest competition in a challenging marketplace.

We will be reviewing the ruling immediately as to grounds for appeal and intend to make a further announcement in the very near future.
